I. SCOPE

This Data Privacy Policy describes the principles and safeguards SkillsEdge Inc. (“Company”, “we” “us”) observes as a personal data controller as it pursues: (1) collection of personal data from data subject on the website; (2) usage and protection of such personal data; (3) processing of such personal data, data sharing and outsourcing; (4) protection of the rights of the data subject with respect to the personal data provided on this website; and (5) for purposes of direct marketing and profiling.

This Data Privacy Policy does not apply to any other information collected by the Company. Our Site may contain links to third party websites/content/services that are not owned or controlled by the Company. The Company is not responsible for how these properties operate or treat your personal data so we recommend that you read the privacy policies and terms associated with these third party properties carefully.

Moreover, when we use the term “you,” we then refer to any individual whose personal, sensitive personal, or privileged information is processed.

II. DATA WE COLLECT AND USE

The Company collects personal data you choose to provide through registrations, applications, enrolments and surveys, and in connection with your inquiries and purchases. Personal data may either be personal information or sensitive personal information, as defined under Republic Act No. 10173 or the “Data Privacy Act of 2012” (the “DPA”) and its Implementing Rules and Regulations. By choosing to provide your name, contact information, and other personal data, you hereby consent to the processing of your personal data within the extent provided for in this Data Privacy Policy. 

By agreeing to this Data Privacy Policy, you understand and acknowledge that the information disclosed herein, including personal data, are collected, processed and stored in the Company’s system and/or in the system of by Thinkific Labs Inc. (“Thinkific”) being the Company’s course and site host . Thinkific provides us with the online course creation platform that allow us to sell our product/services to you. Your data is stored through Thinkific’s data storage, databases and the general Thinkific application. They store your data on a secure server behind a firewall.

Payment

If you make a purchase on our site, we use a third party payment processor such as Stripe or Paypal. Payments are encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our site and related courses and its service providers.

Third Party Services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

OUTSOURCING AND SUBCONTRACTING OF PERSONAL DATA

Rest assured that all our personal information processors are enjoined to comply with the requirements of this Data Privacy Policy, Data Privacy Act of 2012 and its Implementing Rules and Regulations, provisions of which are likewise written in our engagement with said parties.

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

We collect cookies or similar tracking technologies. This means information that our website’s server transfers to your computer. This information can be used to track your session on our website. Cookies may also be used to customize our website content for you as an individual. If you would like to access, review, correct, remove, withdraw, and update personal data that you have provided to us or obtain a copy of your data undergoing processing, you may contact us as indicated in the Contact Us section. We will respond to your request consistent with applicable law. Please note that we may need to retain certain personal data for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion.

Please note, however, that you cannot invoke the foregoing rights when the processed personal information are used only for the needs of scientific or statistical research while observing legal parameters for such use.

VII. RETENTION PERIOD

We will retain your personal data within the Company’s applicable retention schedules for as long as needed or permitted in light of the purpose(s) for which it was obtained and as outlined in this Data Privacy Policy. VIII. DATA BREACH NOTIFICATION

In case of claims involving privacy breach, personal data misuse, or any issue concerning alleged violation of your data privacy rights, you shall notify us within seventy-two (72) hours upon knowledge thereof, detailing the nature of the breach, negative consequences or harm caused, and the assistance or relief sought. This reporting is necessary to help us investigate on said breach and consider appropriate measures in order to avoid recurrence of a similar incident.
